AN ACT TO AMEND THE VACCINATION ACT (CAP 12.19)

BE IT ENACTED by the King and Legislative Assembly of Tonga in the Legislature of the Kingdom as follows:

1. Short Title and interpretation

(1) This Act may be cited as the Vaccination (Amendment) Act 2021.

(2) In this Act, the Vaccination Act (Cap 12.19), as amended, shall be referred to as the 'Principal Act'.

2. New Section 1A

The Principal Act is amended by inserting a new section1A immediately after the current section 1, as follows –

"1A Interpretation
In this Act, unless the context otherwise requires –

• "vaccinate" or "vaccination" means that a person receives a recognised and approved vaccine available under the Therapeutics Goods Act;".

3. Section 4 amended

Section 4 of the Principal Act is repealed and replaced with the following new section –

"4 Vaccination to be compulsory
(1) Subject to section 181A of the Public Health Act [Cap 12.15], every person shall be vaccinated following the declaration made by the Chief Executive Officer.
(2) Any person who fails to comply with subsection (1) commits an offence and is liable upon conviction to a fine not exceeding $1000 or imprisonment for a period not exceeding 6 months, or both.".

4. Section 6 repealed

Section 6 of the Principal Act is hereby repealed.

5. Section 11 repealed

Section 11 of the Principal Act is hereby repealed.

6. Principal Act amended in the Tongan version only

The Principal Act is amended in the Tongan version only by –

(a) deleting the words "Lao ki he Faito'o Tafa" and replacing them with the words "Lao ki he Huhu Malu'i" wherever it appears; and
(b) deleting the words "faito'o tafa" and replacing them with the words "huhu malu'i" wherever it appears.
