An Act to amend the Parliamentary Salaries and Allowances Act 2008

Enacted by the Parliament of Nauru as follows:

1. Short title

This Act may be cited as the Parliamentary Salaries and Allowances (Amendment) Act 2014.

2. Commencement

This Act commences on the date on which it is certified by the Speaker.

3. Act amended

The Schedule amends the Parliamentary Salaries and Allowances Act 2008.

SCHEDULE – AMENDMENT OF PARLIAMENTARY SALARIES AND ALLOWANCES ACT 2008

[1] Insert new section 7A

Withholding of Salaries and Allowances
(1) The payment of salaries and allowances of Members of Parliament, including Members of Cabinet and the President, may be withheld if the Member has been suspended from the House.
(2) The withholding of salaries and allowances may only be done through a simple majority vote of Members of Parliament, excluding any Member who has been temporarily suspended.
(3) Once a Member's suspension is lifted, the suspension of payment of salaries and allowances that the Member is entitled to is also lifted.
(4) The House may also, through a simple majority vote, elect to pay to the Member any salaries and allowances withheld during the Member's period of suspension.
