To replace the Parliamentary Salaries and Allowances Act 1988 to reflect the revised salary structure applying to Members of Parliament and Members of Cabinet.

PARLIAMENTARY SALARIES & ALLOWANCES ACT 2008

To replace the Parliamentary Salaries and Allowances Act 1988 to reflect the revised salary structure applying to Members of Parliament and Members of Cabinet.

Be it enacted by the Parliament of Nauru as follows:


Title


1. This Act shall be known as the Parliamentary Salaries and Allowances Act 2008.


Commencement


2. This Act commences on the day of certification.


Repeal


3. Subject to section 4, the Parliamentary Salaries and Allowances Act 1988 is hereby repealed.


Savings & Effective date


4. (1) The salaries and allowances provided for under this Act shall be deemed to have had effect from 1st July 2006 and all salaries and allowances provided pursuant to the Parliamentary Salaries and Allowances Act 1988 shall be deemed to have ceased and to have been replaced by the salaries and allowances provided pursuant to this Act with effect from 1st July 2006.


(2) Subject to subsection (1) of this section, insofar as any salary or allowances may be lawfully due and owing to any Member of Parliament, the Speaker, the Deputy Speaker, a Minister of Cabinet, the President or any Minister acting as President, pursuant to the Parliamentary Salaries and Allowances Act 1988 up to 30th June 2006, that Act shall be deemed to remain in force for such time and to such extent only as shall be necessary to enable any such salary or allowances due and owing to be paid to any such person as aforesaid.


Salaries and Allowances of Members of Parliament


5. The salaries and allowances of Members of Parliament, including Members of Cabinet and the President shall be as set out in Schedule 1 to this Act.


Charge on Treasury Fund


6. The amounts to which a person shall be entitled under this Act shall be paid from the Treasury Fund which shall be charged accordingly.


Review of Salaries and Allowances


7. The salaries and allowances of Members of Parliament, including Members of Cabinet and the President, may only be amended by Parliament approving amendments to Schedule 1 of this Act.


Regulations


8. Cabinet may make regulations, not inconsistent with this Act, prescribing matters required or permitted by this Act to be prescribed.
