AN ACT to amend the Public Trust Office Act 1975.


[22 August 1997]


BE IT ENACTED by the Legislative Assembly of Samoa in Parliament assembled as follows:-


1. Short title and commencement - (1) This Act may be cited as the Public Trust Office Amendment Act 1997, and shall be read together with and deemed part of the Public Trust Office Act 1975 (hereinafter referred to as the principal Act).


(2) This Act shall come into force on the day upon which it receives the assent of the Head of State.


2. Amendments to section 9 - Section 9 of the principal Act is hereby amended:


(a) By omitting subsection (2) and substituting it with the following subsection:


"(2) The Investment Board shall consist of the following persons, namely:-


(a) The Minister who shall be the Chairman of the Board;


(b) The Financial Secretary;


(c) The Secretary of the Public Service Commission;


(d) The Attorney-General;


(e) The Manager of the National Provident Fund;


(f) A person who is a registered land valuer appointed by the Head of State acting on the advice of Cabinet for a term of 3 years;


(g) Two persons to be appointed by the Head of State acting on the advice of Cabinet for a term of 3 years but who are eligible for reappointment;


(h) The Public Trustee."


(b) By omitting the number "3" from subsection (5) and substituting it with the number "5".


(c) By omitting subsection (6) and substituting it with the following subsection:-


"(6) The Chairman shall preside at all meetings of the Board at which he is present and in his absence from any meeting of the Board he may nominate either the Financial Secretary or the Attorney-General who shall Act as Chairman when required;"


(d) By omitting paragraph (a) of subsection (8) and substituting it with the following paragraph:-


"(a) In the case of the Financial Secretary, the Secretary of the Public Service Commission, the Attorney-General and the Public Trustee; and Senior Officer of his or her respective Department nominated in writing by such member."
