AN ACT to amend the Civil List Act 1964.

[16th July 1996]


BE IT ENACTED by the Legislative Assembly of Western Samoa in Parliament assembled as follows:


1. Short Title -This Act may be cited as the Civil List Amendment Act 1996 and shall be read together with and deemed part of the Civil List Act 1964 (hereinafter referred to as the principal Act).


2. Interpretation -Section 2 of the principal Act is amended by inserting the expression "late sitting" and its definition specified below into its correct alphabetical place in section 2:-


"Late Sitting" means any sitting of the Legislative Assembly that commences at any time after 1p.m.


3. Salary and allowance of Speaker -Section 8 of the principal Act is amended by -


(a) Omitting the expression "$21,395" from paragraph (a) and substituting the expression "$28,503";


(b) omitting paragraph (b) and substituting the following paragraph:-


"(b) A non-taxable allowance at the rate of $3,500 a year to provide for expenses incurred in connection with his official duties in with the Assembly."


4. Salary and allowance of Deputy Speaker -Section 9 of the principal Act is amended by –


(a) omitting from paragraph (a) the expression "$13,231" a year and substituting the expression "$24,835".


5. Salary and allowances of Members of Assembly -Section 10 of the principal Act is amended by omitting paragraph (c) and substituting the following –


"(c) (i) a late sitting allowance of $3.50 per hour;


(ii) a sitting allowance for every hour during which a member is required to attend and does attend any meeting of any Committee of the Assembly at the rate herein specified:


(i) Chairman $4.00 per hour


(ii) Deputy Chairman $3.75 per hour


(iii) Members $3.50 per hour


Provided that in computing the number of hours for the purposes of this paragraph, any fraction of an hour less than half an hour shall not be counted, and any fraction of half an hour or more shall be counted as a full hour.


6. Legislative Salaries and Allowances Orders 1980 - The Legislative Salaries and Allowances Order 1980 continues to be in force but shall be subject to the provisions of this Act.
