CUSTOMS (AMENDMENT) ACT
NO. 20 OF 2007

An Act to amend the Customs Act [CAP 257].

Be it enacted by the President and Parliament as follows:

1. Amendment

The Customs Act [CAP 257] is amended as set out in the Schedule.

2. Commencement

2. This Act commences on the day on which it is published in the Gazette.

SCHEDULE

AMENDMENTS OF THE CUSTOMS ACT [CAP 257]

1 Subsection 18(1)

Delete "after", substitute "before the"

2 Paragraph 31(1)(b)

After "lodged" insert "at least 48 hours before the arrival into Vanuatu of the aircraft or ship carrying the imported goods,"

3 After subsection 31(9)

Insert

"(9A) A person who fails to lodge the declaration as required under paragraph (1)(b) is guilty of an offence and is punishable on conviction to a fine not exceeding:

(a) in the case of an individual -VT100,000 or a term of imprisonment of not more than one year, or both; or

(b) in the case of a body corporate -VT500, 000."

4 After paragraph 102(1) (e)

Insert

"(eaa) subsection 31 (9A); or"
