MALARIA (CONTROL)

To facilitate malaria control on plantation land.

DESTRUCTION OF COCONUT SHELLS

1. (1) Every person occupying cultivated land whether owner, tenant, manager or agent thereof shall be responsible for the taking of all necessary measures with a view to preventing any coconut shell capable of holding rain water on the said land being used as a breeding place for mosquitoes.

(2) Nothing in this section shall apply to coconut shells collected for fuel purposes provided that such shells are so disposed that they cannot hold rain water nor to complete nuts on the ground.


OFFENCES

2. A person referred to in section 1 shall be deemed to have committed an offence against this Act if coconut shells capable of holding rain water are found on the land used, managed or administered by the said person:

Provided that no offence shall be deemed to have been committed unless the said coconut shells shall be found on the ground in sufficient number to establish the bad faith or negligence of the person responsible.


ESTABLISHMENT OF OFFENCES

3. (1) District Commissioners, police officers, medical officers and sanitary inspectors may enter on any land or premises in order to check the application of this Act and may establish offences thereunder.

(2) It shall be an offence under this Act to obstruct such officials in the course of their duty as aforesaid.


PENALTIES

4. Offences against this Act shall be punishable on conviction by a fine not exceeding VT30,000 and 1 month's imprisonment or by one or other of these penalties.


APPLICATION OF ACT

5. This Act shall be applicable only to the islands of Efate, Fila, Erakor, Leleppa, Moso, Nguna and Pele, provided that it may be extended by Order of the Minister responsible for health to other areas in Vanuatu.
