Fencing Act [Cap 13]

FENCING

FENCING

To provide for the fencing of land.

INTERPRETATION

1. In this Act-

"Minister" shall mean the Minister responsible for land.


NOTICE TO FENCE LAND

2. Whenever it shall appear desirable to the Minister that any block of land or any portion thereof should be fenced the Minister may serve or cause to be served by any person authorised by him notice on the owner or occupier of any such land to erect fences in accordance with the terms and specifications prescribed in the said notice.


NOTICE TO MAINTAIN FENCES

3. Whenever it shall appear desirable to him the Minister may serve or cause to be served by any person authorised by him notice on the owner of or occupier of any land requiring him to maintain his fences and gates in a good and sufficient state of repair.


OFFENCES

4. Any person who fails to comply with the terms of or prevents or obstructs the execution of the terms of any notice issued and duly served under this Act shall be guilty of an offence.


MINISTER MAY TAKE STEPS TO EXECUTE WORK REQUIRED BY NOTICE

5. In the event of failure to comply with any of the terms of any notice issued and duly served under this Act, the Minister may take or cause to be taken such steps as may be required to ensure the execution of any work required by such notice, the cost of which shall be recoverable from the person concerned. Any person who prevents or obstructs the execution of any work as aforesaid shall be guilty of an offence.


PENALTY

6. Offences against this Act shall be punishable on conviction by a fine not exceeding VT30,000 and by imprisonment not exceeding 1 month or by one or other of such penalties.
