TUVALU TELECOMMUNICATIONS CORPORATION (AMENDMENT) ACT 2012

AN ACT TO AMEND THE TUVALU TELECOMMUNICATIONS CORPORATION ACT TO VEST THE REGULATORY POWER TO SUPPLY, ESTABLISH AND DEVELOP TELECOMMUNICATIONS SYSTEMS IN TUVALU IN THE MINISTER RESPONSIBLE FOR TELECOMMUNICATIONS AND RELATED PURPOSES

ENACTED BY THE PARLIAMENT OF TUVALU

Commencement [4th May, 2012]

1 Short Title

This Act may be cited as the Tuvalu Telecommunications Corporation (Amendment) Act 2012.

2 Commencement

This Act shall come into operation on the date of publication by exhibition.

3 Amendment
The Tuvalu Telecommunications Corporation Act is amended as follows:

(a) Delete section 6 of the Tuvalu Telecommunications Corporation Act and insert these words —

6 Corporations right to supply telecommunication services

(1) The Corporation shall have non-exclusive right to supply telecommunication services and to establish and develop telecommunication systems in Tuvalu in accordance with its functions under the Act.

(2) The Minister may by Order grant a licence to a person other than the Corporation to supply, establish and develop telecommunication systems or services in Tuvalu upon such other conditions as may be prescribed by regulations and contained in the licence.

(b) Delete section 37 (1) and renumber the remaining paragraphs of section 37 of the Act.
