LOCAL OFFICES (MISCELLANEOUS AMENDMENTS) ACT 1996

AN ACT to amend the Island Courts Act, the Local Government Act, the Native Lands Act and the Co-operative Societies Act to remove the prohibition on members or special members of any committee of a co-operative society from serving on Island Courts, Island and Town Councils, Lands Courts and the Lands Courts Appeals Panel.

ENACTED by the Parliament of Tuvalu-

Short title and commencement

1. This Act may be cited as the Local Offices (Miscellaneous Amendments) Act 1996 and shall come into commencement operation on such date as the Minister shall by notice appoint.

Amendment of Cap. 3

2. The Island Courts Act is amended by repealing paragraph 9(2)(d).

Amendment of Cap. 19

3. The Local Government Act is amended by repealing paragraph (9)(2)(j).

Amendment of Cap. 22

4. The Native Lands Act is amended by repealing paragraphs 6(2)(c) and 9(2)(c).

Amendment of Cap. 64

5. The Co-operative Societies Act is amended by:

(a) repealing section 23A; and

(b) inserting a full stop after paragraph 62(2)(b) and deleting all words thereafter.

LOCAL OFFICES (MISCELLANEOUS AMENDMENTS) ACT 1996

EXPLANATORY MEMORANDUM
(This memorandum is not part of the Act)

The purpose of this Act is to amend various legislation that impose a restriction on the members or special members of a cooperative society on becoming members of Islands Courts, Lands Courts, the Lands Court Appeals Panel and Island and Town Councils. The Acts required to be amended are the Island Courts Act (clause 2), the Local Government Act (clause 3), the Native Lands Act (clause 4) and the Co-operative Societies Act (clause 5). The effect of the amendments is to remove the restriction imposed on members or special members of a cooperative society from serving on the various local courts and Island and Town Councils.
