TONGA LAW SOCIETY ESTABLISHMENT REGULATIONS 1990

LAW PRACTITIONERS ACT 1989


[26th January 1990]


IN EXERCISE of the powers conferred by section 28 of the Law Practitioners Act, 1989 the Minister of Justice, with the consent of Cabinet, makes the following regulations: —


1 Title.


These regulations may be cited as the Tonga Law Society Establishment Regulations 1990.


2 Interpretation.


In these regulations, unless the contrary intention appears —


"the Act" means the Law Practitioners Act, 1989;


"the Council" means the Council of the Society elected at the first general
meeting of the Society;


"the first general meeting of the Society" means the meeting of the
Society provided for in these regulations;


"the Rules" means the Constitution of the Society as set out in the Second Schedule to the Act;


"the Secretary" means the Secretary of the society appointed by these regulations; and


"the Society" means the Tonga Law Society established by the Act.


3. Secretary


(1). Notwithstanding the Rules, Kenneth Peter Whitcombe of the Crown Law Department is hereby appointed the Secretary of the Society.


(2). The Secretary appointed under sub-clause (1) of this regulation shall hold office until the Council appoints a Secretary under rule 10.1 of the Rules.


4. Nominations,


(1). Notwithstanding the rules, nominations of members for elections to the Council must-


(a). subject to sub-clause (2) of this regulation, be in writing signed by two or more members of the Society as nominators and endorsed with the consent of the nominee; and


(b). be received by the Secretary not later than 4.00 p.m. on Thursday 1 February 1990.


(2). For the purposes of paragraph (a) of sub-clause (1), nominator or nominee shall be deemed to be a member of the society if, and only if-


(a). he was a licensed lawyer immediately before the commencement of the Act; and


(b). he has been issued a practising certificate under section 7 of the Act by not later than 4.00 p.m. on Friday 23 February 1990.


(3). The Secretary shall, by not later than 4.00 p.m. on Friday 2 February 1990, exhibit a written notice of all nominations received under subclause (1) of this regulation at and within the public office of the Supreme Court Registry at Nuku'alofa.


5. First General Meeting.


(1). Notwithstanding the Rules-


(a). the first general meeting of the society shall be held on Friday 23 February 1990 at the Supreme Court in Nuku'alofa commencing at 4.00 p.m.;


(b). the order of business at such first general meeting of the Society shall be —


(i). Election of President and Vice President,


(ii). Election of Treasurer,


(iii). Election of other members of the Council,


(iv). Appointment of Auditor,


(v). Determination of membership fee, and


(vi). General Business; and


(c). such first general meeting of the Society shall be deemed to be the first annual general meeting of the Society.


(2). Notwithstanding the Rules, the next annual general meeting of the society shall be held not-


(a). earlier than 30 June 1991; nor


(b). later than 30 September 1991.


6. Financial Year.


Notwithstanding the Rules, the first financial year of the Society shall be the period of 18 months concluding on 30 June 1991.


7. Notice.


Every member of the society shall be deemed to have actual notice of these regulations and the notice referred to in sub-clause (3) of regulation 4 of these regulations, as if such regulations and notice had been personally served on him by the Secretary and the Society.
