Nationality Act - Nationality (Re-admission) Regulations 2007

NATIONALITY (RE-ADMISSION) REGULATIONS 2007


NATIONALITY ACT (CAP.59)


[4th day of January 2008]


IN EXERCISE of the powers conferred on him by section 15 of the Nationality Act (CAP.59), the Prime Minister with the consent of Privy Council hereby makes the following Regulations:


1. (1) These Regulations may be cited as the Nationality (Re-admission) Regulations 2007.


(2) These Regulations apply to persons who lost their Tongan nationality prior to the commencement of the Nationality (Amendment) Act 2007.


2. (1) All applications under these Regulations shall be filed with the Minister for Foreign Affairs or any Tonga Diplomatic or Consular office.


(2) Every application shall be —


(a) made in Form 1 of Schedule 1 of these Regulations; and


(b) submitted together with —


(i) 2 passport sized photos;

(ii) birth certificate of applicant;

(iii) proof of foreign citizenship;

(iv) medical report on the applicant by a registered medical practitioner;

(v) police record on the applicant;

(vi) the appropriate fee prescribed in Schedule 2 of these Regulations; and

(vii) such other documents as may be required by the Minister for Foreign Affairs to complete such application.


(3) Every applicant for re-admission, after lodging his application shall be interviewed by the Minister for Foreign Affairs or any officer duly authorized by him to conduct such interview.


3. The certificates of re-admission to Tongan nationality issued pursuant to section 17 of the Nationality Act shall be in Form 2 of Schedule 1.


4. (1) A certificate of re-admission shall not be issued until the applicant has taken the oath of allegiance as prescribed by the Nationality Act.


(2) The oath of allegiance shall be taken and signed in the presence of the Prime Minister, the Minister for Foreign Affairs or a diplomatic or consular officer or senior Government officer authorized in writing by the Prime Minister.

CERTIFICATE OF READMISSION TO TONGAN NATIONALITY


WHEREAS......................................................a citizen of.............................................. desiring to be re-admitted to Tongan Nationality has applied for a grant of a certificate of re-admission in the Kingdom of Tonga pursuant to the Nationality Act,


AND WHEREAS the said..........................................................has fulfilled the required conditions for obtaining such certificate as set out in the said Nationality Act,


AND WHEREAS the Minister for Foreign Affairs has on the.........................day of.........................................20................. consented to the grant of certificate of re-admission to the said ........................................................................;
