MAGISTRATES' COURTS (AMENDMENT) ACT 2000

AN ACT


TO AMEND THE MAGISTRATES' COURTS ACT


[18th July, 2000]


BE IT ENACTED by the King and Legislative Assembly of Tonga in the Legislature of the Kingdom as follows:-


1. (1) This Act may be cited as the Magistrates' Courts (Amendment) Act 2000.


(2) The Magistrates' Courts, (Cap. 11), as amended, is in this Act referred to as the Principal Act.


(3) This Act shall come into force on the same date as the Bailiffs Act 2000.


2. Section 17 of the Principal Act is amended as follows -


(i) In subsection (1) by inserting the word "Bailiff" immediately before the word "constable";


(ii) by adding a new subsection (3) -


"(3) A Certificate of Service completed according to the Bailiffs' Act 2000 shall be sufficient evidence of service of such documents."


3. Section 53 of the Principal Act is amended by deleting the words "police officer" and substituted by the word "Bailiff".


4. Sections 18, 54, 55, 56, 57 and Form 3 from the Schedule to the Principal Act are repealed.
