MAGISTRATES' COURTS (AMENDMENT) ACT 1997

AN ACT


TO AMEND THE MAGISTRATES' COURTS ACT


[11th September, 1997.]


BE IT ENACTED by the King and Legislative Assembly of Tonga in the Legislature of the Kingdom as follows:-


1. (1) This Act may be cited as The Magistrates' Courts (Amendment) Act 1997.


(2)The Magistrates' Courts, (Cap 12), as amended, is in this Act referred to as the Principal Act.


2. Section 16 of the Principal Act is amended by inserting the number "(1)"after "16." and adding a new subsection thereto as follows:


"(2) Where, in any district of the Kingdom, there is no resident magistrate, then the Government Representative for that district may sign any summons for the purpose of the commencement of the proceedings under this section.".


3. Section 61 of the Principal Act is amended by adding a new subsection thereto as follows:


"(3) Where, in any district of the Kingdom, there is no resident magistrate, then the Government Representative for that district may sign any summons for the purpose of the commencement of the proceedings under this section.".


Passed by the Legislative Assembly this 11 day of September, 1997.
