EVACUATION OF FOREIGNERS ACT

AN ACT TO CONFER UPON HIS MAJESTY IN COUNCIL CERTAIN POWERS TO EVACUATE FOREIGNERS


Commencement [14th October, 1942]


1 Short title.


This Act may he cited as the Evacuation of Foreigners Act.


2 Power to order evacuation of foreigners.


On any occasion which His Majesty in Council may consider to he an occasion of emergency or public danger His Majesty in Council may in the interest of good government and the welfare of the Kingdom order the complete or partial evacuation of foreigners from the Kingdom:


Provided that for the purpose of this Act foreigners shall be deemed to be any person who is not of Tongan nationality or a member of any Polynesian or Melanesian race.


3 Competent Authority.


His Majesty in Council shall appoint a Competent Authority for Evacuation and such Competent Authority shall be responsible for the effective enforcement of any such evacuation or partial evacuation as His Majesty in Council may provide and shall have full power to enforce any lawful orders, rules or restrictions which it may at any time be necessary for the Competent Authority to issue in connection with such order of evacuation:


Provided that in case of necessity the Competent Authority may should he deem fit exempt any person from evacuation.


4 Treasurer to advance money for effecting evacuation.


For the purpose of carrying out any such order of evacuation the Treasurer shall on the authority of the Competent Authority advance money from public funds for the transport, accommodation, maintenance and care of persons so evacuated.


5 Limitation.


Any such order of evacuation shall remain effective until it be rescinded by His Majesty in Council.


6 Penalties.


Any person who contravenes or fails to comply with any lawful order, rule or restriction issued by the Competent Authority in connection with evacuation shall be guilty of an offence against this Act and shall be liable to imprisonment for a term not exceeding 3 months or a fine not exceeding $500 or to both such imprisonment and fine. (Amended by Act 24 of 1988.)
