TOKELAU
IMMIGRATION AMENDMENT RULES

These amendments enable long-term residents of Tokelau to become permanent residents, enable government officials to enter Tokelau without permits, and enable permit-holders to leave Tokelau during the time of the permit and return without the need for a new permit.

IMMIGRATION AMENDMENT RULES 2003

The Tokelau Immigration Regulations 1991 are amended:

(i) In regulation 7 by repealing paragraph (iv) and inserting the following paragraph in its place:

"(iv) Special permits, which may be granted for a period not exceeding 3 years, allow the permit holder to reside and work in Tokelau;"

(ii) In regulation 7 by adding the following:

"(v) Permits for permanent residence, which may be granted to a person who has been an ordinary resident of Tokelau for at least 3 years, allow the holder to reside and work in Tokelau indefinitely."

(iii) In regulation 8 by adding the following:

"(3) No permit is required by a person who is certified by the Government of Tokelau to be on the official business of the government or a village, to enter, work in, or reside in Tokelau for the duration of the task."

(iv) By repealing regulation 10(3)(iii).

(v) In regulation 7(i) by deleting "10" and inserting "30".

(vi) In regulation 9 by adding the following:

"(6) The Council of the Ongoing Government shall, within one month of receipt of the completed application by the Council of Ongoing Government, grant or refuse the application."

(ii) I te Vaega 7 e fakaopoopo kiei:

"(v) Pemita mo na tino nofo mau, e mafai ke tuku atu ki he tino kua nofo i Tokelau mo he 3 tauhaga, e fakataga ai te tino e o ia te pemita ke nofo ma galue tumau i Tokelau."

(iii) I te Vaega 8 e fakaopoopo kiei:

"(3) E he manakomia he pemita e he tino kua fakamaonia e te Malo o Tokelau ke fakatino ni galuega a te malo pe ko te nuku, ke ulufale, galue pe nofo i Tokelau mo te taimi e fakatino ai te galuega."

(iv) I te kavekehea o te vaega 10(3)(iii);

(v) I te Vaega 7(i) i te kavekehea o te "10" kae tuku ki loto te "30";

(vi) I te Vaega 9, fakaopoopo kiei:

"(6) Ko te Fono a te Malo Fakaauau, ka, i loto o he mahina talu te maua o te tuhi talohaga e te Fono a te Malo Fakaauau, talia pe he talia te tuhi talohaga."
