EXCHANGE OF NOTES CONSTITUTING AN AGREEMENT BETWEEN THE GOVERNMENT OF AUSTRALIA AND THE GOVERNMENT OF THE REPUBLIC OF NAURU TO FURTHER AMEND THE SCHEDULE TO THE AGREEMENT RELATING TO AIR SERVICES OF 17 SEPTEMBER 1969

[Note from the Australian High Commission, Nauru, to the Department of External Affairs of Nauru]

Note No. 09/84

The Australian High Commission presents its compliments to the Department of External Affairs of Nauru and has the honour to refer to the agreement between the Government of the Commonwealth of Australia and the Government of the Republic of Nauru relating to air services, done at Canberra on 17 September 1969 and amended by an exchange of notes on 12 August 1975, and to propose that the route schedule be deleted and replaced with the following route schedule:

"Route Schedule

(1) Australian Route

The route to be operated in both directions by the designated airline of Australian shall be Australia via Papua New Guinea, Honiara, Noumea to Nauru.

(2) Nauruan Route

The route to be operated in both directions by the designated airline of Nauru shall be Nauru to Melbourne via Sydney as an intermediate point.

Intermediate points on any of the above routes may at the option of the designated airline concerned be omitted on any or all flights, provided that an agreed service shall have its starting point or terminal in the territory of the contracting party designating the airline.

The designated airline of Nauru shall not exercise traffic rights between Sydney and Melbourne or vice-versa."

The Australian High Commission has the honour to propose that if the foregoing is acceptable to the Government of the Republic of Nauru, this note and the Department of External Affairs' reply to this effect shall together constitute and evidence an agreement between the two Governments amending the agreement which shall enter into force on the date of the Department of External Affairs' note.

The Australian High Commission avails itself of this opportunity to renew to the Department of External Affairs of Nauru the assurances of its highest consideration.

The Department of External Affairs of the Republic of Nauru presents its compliments to the Australian High Commission and has the honour to refer to the High Commission's Note No. 09/84 of 2 February 1984, which reads:

The Department of External Affairs has the further honour to confirm that the foregoing is acceptable to the Government of the Republic of Nauru and that the High Commission's note and this note in reply shall together constitute and evidence an agreement between the two Governments amending the agreement relating to air services, done at Canberra on 17 September 1969 and amended by an exchange of notes of 12 August 1976, which shall enter into force on the date of this note.

The Department of External Affairs of the Republic of Nauru wishes to avail itself of this opportunity to renew to the Australian High Commission the assurances of its highest consideration.
