ARRANGEMENT OF SECTIONS.

Licensing of Heavy Vehicles Regulation 1977

Made under the Licensing of Heavy Vehicles Act 1977.

  1. APPLICATION FOR LICENCES.

An application for–

(a) a highway licence shall be in Form 1A; and

(b) a provincial licence shall be in Form 1B; and

(c) a renewal of a licence shall be in Form 1C,

and shall be accompanied by the fee applicable in accordance with Schedule 2.

  1. PERMIT.

(1) A permit issued under Section 13 of the Act shall be in Form 2.

(2) The fee for a permit shall be in accordance with the fees specified in Schedule 2.

  1. LICENCE.

(1) A provincial licence shall be in Form 3.

(2) A highway licence shall be in Form 4.

(3) The fee for a replacement licence when a licence has been lost, defaced or destroyed is K5.00.

  1. LABEL.

(1) A person to whom a licence is granted under the Act shall be issued with a label–

(a) in respect of a provincial licence–in Form 5; and

(b) in respect of a highway licence–in Form 6,

at the same time as the licence is issued.

(2) A label issued under Subsection (1) shall be affixed to the windscreen of the vehicle as near as possible to the current registration label issued under the Motor Traffic Act.

(3) The fee for a replacement label where a label has been lost, defaced or destroyed is K2.00.

(4) A person who owns or operates or permits to be operated a heavy vehicle for hire or reward without having affixed a label issued under Subsection (1) is guilty of an offence.

Penalty: A fine not less than K20.00 and not exceeding K100.00.

  1. TRANSFER OF LICENCE.

The fee for the transfer of a licence–

(a) where the licence is transferred from one vehicle to another vehicle of similar type, both vehicles having the one owner is K5.00; and

(b) when the licence is transferred from one owner to another owner under an agreement or arrangement for the sale of a licensed vehicle is K50.00.

  1. REFUND.

Where a person surrenders a licence that is valid for a period exceeding one month after the date of surrender, the licensing authority shall, on the written application of that person, refund to him an amount equal to one-twelfth of the annual fee charged for each complete month of the unexpired portion of the licence.

SCALE OF FEES.

1. Highway Licence and Provincial Licence Fees.

(a) K20.00 per tonne of load capacity of the vehicle plus K20.00 per tonne of load capacity of trailer used with vehicle for commercial carrying;

(b) K10.00 per tonne of load capacity of the vehicle plus K10.00 per tonne of load capacity of trailer used with vehicle for carrying of goods belonging to owner or operator of vehicle;

(c) K5.00 per tonne of load capacity of the vehicle plus K5.00 per tonne of load capacity of trailer used with vehicle for carrying of goods between one province and an adjoining province.

2. Permit Fees.

(a) For specified time–at the rate per annum of K20.00 per tonne of load capacity of the vehicle plus K20.00 per tonne of load capacity of trailer used with vehicle calculated for the period not exceeding 12 months for which permit is issued;

(b) For a particular journey or particular journeys–for each journey K5.00 per tonne of load capacity of the vehicle plus K5.00 per tonne of load capacity of trailer used with the vehicle.
