Table of Contents

Cabinet makes the following Regulations under section 32 of the Naoero Citizenship Act 2017:

Citation

These Regulations may be cited as the Naoero Citizenship (Forms and Fees) Regulations 2019.

Commencement

These Regulations come into effect on the day they are notified in the Gazette.

Citizenship Register

For the purpose of section 5 of the Act, the Register established and maintained by the Secretary may be kept as set out in Schedule 1:

(a) in writing; and

(b) in electronic form that is readily retrievable.

Public access to Register
- (1) Subject to subregulation (2), information from the Register may be disclosed:
  - (a) only in respect of a named individual; and
  - (b) on request, in a manner specified by the Secretary, by:
    - (i) the individual concerned;
    - (ii) a person who has authorisation of the named individual;
    - (iii) a person who needs confirmation of the citizenship status of a parent or grandparent to establish a claim to citizenship; or
    - (iv) a person who satisfies the Secretary that he or she requires the information for a genuine and proper purpose that is related to the relevant part of the Register.
- (2) Information from the Register may be disclosed for any of the following purposes:
  - (a) to avoid prejudice to the maintenance of the law by a public sector agency;
  - (b) for the conduct of any proceedings before any court or tribunal; or
  - (c) for the purpose of the Electoral Act 2016.
Application

An application for the grant of citizenship:

(a) by birth and residency under section 11 of the Act shall be in Form 1 of Schedule 2;

(b) by descent under section 12 of the Act shall be in Form 2 of Schedule 2;

(c) by marriage under section 13 of the Act shall be in Form 3 of Schedule 2;

(d) by virtue of adoption under sections 14 and 15 of the Act shall be in Form 4 of Schedule 2; or

(e) by former citizens under section 17 of the Act after renunciation of citizenship, shall be in Form 5 of Schedule 2.

Particulars required for application for citizenship
- (1) For the purpose of an application for citizenship under section 11 of the Act, the applicant shall provide:
  - (a) surname and forenames;
  - (b) date of birth;
  - (c) gender;
  - (d) telephone number;
  - (e) email address;
  - (f) usual residential address or correspondence address;
  - (g) his or her nationality and if that nationality is not the nationality of origin, the nationality of origin;
  - (h) his or her recent passport size photograph;
  - (i) original or certified true copy of the original birth certificate;
  - (j) evidence of means of support;
  - (k) evidence that the applicant is a resident of the Republic and has been resident for a continuous period of 20 years;
  - (l) sworn character references based on personal knowledge of the applicant from 2 citizens of good standing in the community in which the applicant resides; and
  - (m) police clearance by Nauru Police Force or any other country the applicant has resided for some time other than just short duration of stay.
- (2) For the purpose of an application for citizenship under section 12 of the Act, the applicant shall provide:
  - (a) surname and forenames;
  - (b) date of birth;
  - (c) gender;
  - (d) telephone number;
  - (e) email address;
  - (f) usual residential address or correspondence address;
  - (g) his or her recent passport size photograph;
  - (h) original or certified true copy of the original birth certificate;
  - (i) evidence of means of support;
  - (j) evidence that at least one or more of the maternal or paternal grandparents of the applicant were citizens;
  - (k) sworn character references based on personal knowledge of the applicant from 2 citizens of good standing in the community in which the applicant resides; and
  - (l) police clearance by Nauru Police Force or any other country the applicant has resided for some time other than just short duration of stay.
- (3) For the purpose of an application for citizenship under section 13 of the Act, the applicant shall provide:
  - (a) surname and forenames;
  - (b) date of birth;
  - (c) gender;
  - (d) telephone number;
  - (e) email address;
  - (f) usual residential address or correspondence address;
  - (g) his or her nationality and if that nationality is not the nationality of origin, the nationality of origin;
  - (h) his or her recent passport size photograph;
  - (i) original or certified true copy of the original birth certificate;
  - (j) marriage certificate;
  - (k) evidence of means of support;
  - (l) police clearance from country of origin and by the Nauru Police Force;
  - (m) medical report;
  - (n) details of spouse;
  - (o) length of residency in the Republic;
  - (p) evidence that the applicant is a resident of the Republic and has been resident for a continuous period of 7 years with his or her spouse; and
  - (q) sworn character references based on personal knowledge of the applicant from 2 citizens of good standing in the community in which the applicant resides.
- (4) For the purpose of an application for citizenship under section 15 of the Act, the applicant shall provide:
  - (a) full name of the child;
  - (b) original or certified true copy of the original birth certificate of the child;
  - (c) original or certified true copy of the original of the adoption order;
  - (d) evidence that the applicant is a citizen;
  - (e) original or certified true copy of the applicant’s marriage certificate;
  - (f) original or certified true copy of the applicant’s birth certificate;
  - (g) evidence of means that the applicant is able to and will support the child; and
  - (h) evidence that the child is present in the Republic.
Certificate of citizenship

For the purpose of section 21 of the Act, a certificate attesting to the grant of citizenship to any person shall be in Form 6 of Schedule 2.

Declaration for renunciation of Nauruan citizenship

For the purpose of section 22 of the Act, a declaration for renunciation of citizenship shall be in Form 7 of Schedule 2.

Fees

The fees set out in Schedule 3 are payable in respect of the matters set out in that schedule.
