Enacted by the Parliament of Nauru as follows:

1 Short title

This Act may be cited as the Ports and Navigation (Amendment) Act 2020.

2 Commencement

This Act commences on certification by the Speaker.

3 Amendment of the Ports and Navigation Act 2019

The Ports and Navigation Act 2019 is amended by the provisions of this Act.

4 Amendment of Section 12

Section 12 is amended by inserting a new subsection (7) as follows:

‘(7) Notwithstanding subsection (4), the Authority may with the approval of the Responsible Minister, establish or incorporate an entity to provide commercial services, including as an agent for a vessel or owner of a vessel, independent of the functions of the Authority, provided such entity complies with the requirements of this Act, any other written law or such other matters as the Responsible Minister or the Board may direct.'
