Liquor (Amendment) Act 2014

Act No. 26 of 2014

An Act to amend the Liquor Act 1967

Certified: 23rd December 2014

Enacted by the Parliament of Nauru as follows:

  1. Short title

This Act may be cited as the Liquor (Amendment) Act 2014

  1. Commencement

This Act commences on the date on which it is certified by the Speaker.

The Schedule amends the Liquor Act 1967

SCHEDULE – AMENDMENT OF THE LIQUOR ACT 1967

[1] Amendment of section 45

Omit

Current section 45

Substitute

(1) A licensee guilty of an offence under this Ordinance for which no express penalty is provided shall be liable to a penalty of up to fifteen thousand dollars ($15,000) or to imprisonment for twelve months, or both.

(2) Any other person who is not a licensee under this Act and is guilty of an offence under this ordinance for which no express penalty is provided shall be liable to a penalty of up to twenty thousand dollars ($20,000) or to imprisonment for two months, or both

[2] Insert new section 45A

45A Power of the Court under this Ordinance

For officers under this Ordinance, the District Court of Nauru shall have the power to order a penalty of up to twenty thousand dollars ($20,000).

[3] Repeal section 46

Section 46 is here by repealed.

[4] Amendment of section 50

Insert new section 50 (5)

'Any liquor seized under subsection (3) that has not been returned for reasons that the person from whom it was seized has been charged and convicted for the alleged offence, shall be disposed of by public auction.'

[5] Amendment of section 60 (b)

New clause will now read:

'Cabinet may make regulations prescribing all matters which are necessary or convenient to be prescribed for giving effect to this Act and, in particular:

(a) prescribing fees payable for a license under this Act; and
(b) prescribing penalties not exceeding $10,000 for offences against the regulations.'
