Enacted by the Parliament of Nauru as follows:


1 Short title


This Act may be cited as the Education (Amendment) Act 2015.


2 Commencement


This Act commences upon certification by the Speaker.


3 Act Amended


The Schedule amends the Education Act 2011.


SCHEDULE - AMENDMENT OF EDUCATION ACT 2011


[1] Amendment of section 109


1.1 Amend subsection (2)


Omit


Penalty: $100'


Substitute


Penalty: $10,000 fine or imprisonment for 1 year or both


1.2 Amend subsection (3)


Omit


Penalty: $200'


Substitute


Penalty: $20,000 fine or imprisonment for 2 years of both


1.3 Amend subsection (4)


Omit


Penalty: $200.


Substitute


Penalty: $20,000 fine or imprisonment for 2 years or both


New clause will now read:


109 Offences on school premises


(1) In this section:


'school premises' means land (including a building or structure on the land) occupied by a school.


(2) A person must not trespass on school premises.


Penalty: $10,000 fine or imprisonment for 1 year or both.


(3) A person who is not a student of the school commits an offence if the person behaves in an offensive or disorderly way on school premises.


Penalty: $20,000 fine or imprisonment for 2 years or both.


(4) A person commits an offence if the person:


(a) is on school premises; and


(b) is directed to leave the premises by a police officer, the principal of a school or a person authorised by the principal; and


(c) fails to leave the premises in accordance with the direction.


Penalty: $20,000 fine or imprisonment for 2 years or both.


(5) An offence against this section is a strict liability offence.
