AN ACT

to amend section 307 of the Tax Collection Act, in order to rebate 40 percent of tax revenues on land lease payments collected from Kwajalein Atoll into a special account to supplement grants appropriated by the National Government to the Kwajalein Atoll Local Government.

ENACTED BY THE NITIJELA OF THE REPUBLIC OF THE
MARSHALL ISLANDS

Section 1. Short Title.

This Act may be cited as the Tax Collection (Kwajalein Special Account) (Amendment) Act, 2009.

Section 2. Amendments.

(i) Section 307 of the Tax Collection Act, is hereby amended to read as follows:

§307. Distribution of Revenues

(1)The Secretary of Finance shall deposit taxes collected into the appropriate Fund of the Republic.

(2) Notwithstanding the purpose and intent of Article VIII of the Constitution, and subject to the powers of the Secretary of Finance under Subsection 1 of this Section, 40 percent of tax revenues on land lease payments collected from the Kwajalein Atoll, shall be rebated to the Kwajalein Atoll Local Government for the purpose of supplementing grants appropriated by the National Government to the Kwajalein Atoll Local Government under Section 135 of the Local Government Act.

(3) There shall be paid into a special account (Kwajalein Special Account), at the beginning of each fiscal year, 40 percent of tax revenues collected for the purpose of supplementing the Kwajalein Atoll Local Government.

(4) The Secretary of Finance shall maintain and keep records of the Kwajalein Special account.

Section 3. Effective Date.

This Act shall take effect on the date of certification in accordance with the Constitution and the Rules of Procedures of the Nitijela.

I hereby certify:

(1) That Nitijela Bill No: 40ND1 was passed by the Nitijela of the Republic of the Marshall Islands on the 13th day of May, 2009; and

(2) That I am satisfied that Nitijela Bill No.: 40ND1 was passed in accordance with the relevant provisions of the Constitution of the Republic of the Marshall Islands and the Rules of Procedures of the Nitijela.
