MOTOR TRAFFIC (AMENDMENT) ACT (NO.2) 2011

AN ACT

to amend section 47 of the Motor Traffic Act 1986, by inserting a new section, Section 47B to regulate riding a pickup vehicle.

BE IT ENACTED BY THE NITIJELA OF THE REPUBLIC OF THE MARSHALL ISLANDS:

Section 1. Short Title.

This Act may be cited as the Motor Traffic (Amendment) Act (No.2), 2011.

Section 2. Amendments.

(1) Section 47 of the Motor Traffic Act is amended by inserting a new section 47B as follows:

§47B. Riding and overcrowding a pickup vehicle.

(1) Except for the purpose of testing, repairing or engaging in any activity directly relating to maintenance of road or any property, no driver of a pickup vehicle shall allow any person to sit or stand on sides, roofing, canopy or elsewhere outside of a pickup vehicle while it is moving.

(2) The owner or driver of a pickup vehicle shall not allow more persons to ride or be carried on the pickup vehicle more than the load the vehicle is licensed to carry, or allow overcrowding of such vehicle that such proceeding is unsafe by reason of insufficiency of space available for such persons to position themselves securely while the vehicle is moving.

(3) Any driver of a pickup vehicle who violates this section shall be punishable to a fine not exceeding $50 or to imprisonment not more than 3 months or both.

Section 3. Effective Date

This Act shall take effect on the date of certification in accordance with the Constitution and the Rules of Procedures of the Nitijela.
