Motor Traffic (Amendment) Act 2011

NITIJELA OF THE REPUBLIC OF THE MARSHALL ISLANDS

MOTOR TRAFFIC (AMENDMENT) ACT 2011.


AN ACT


to amend the Motor Traffic Act, 1986 by inserting a new section to require a driver and a front-seat passenger of a motor vehicle to be restrained by seat belt while a motor vehicle is operated.


BE IT ENACTED BY THE NITIJELA OF THE REPUBLIC OF THE MARSHALL ISLANDS:


Section 1. Short Title


This Act may be cited as the Motor Traffic (Amendment) Act, 2011.


Section 2. Amendments


(1) Section 141 of the Motor Traffic Act is hereby amended by inserting a new language to read as follows:


§141. Requirement for seat belt usage.


(1) It is unlawful for any person to operate a motor vehicle unless:


(a) the person is restrained by a seat belt;


(b) each passenger in the front seat is restrained by a seat belt; or in a case of an infant child, is restrained by a restraining device.


(2) Any driver of a motor vehicle who violates subsection (1) shall be punishable by a fine of $50 or an imprisonment not more than 3 months or both.


(3) For the purpose of this section, "infant" includes any child below the age of 3 years, and "restraining device" includes car seat for children or any special restraining device for children.


(4) Any payment of fine made under subsection 2 shall be deposited as follows:


(a) Fifty percent (50%) to the Justice Special Revenue Fund.


(b) Fifty percent (50%) to the Judiciary Fund.


Section 4. Transition


The provisions of section 141 shall become enforceable six (6) months after the date of certification.


Section 3. Effective date


This Act shall take effect on the date of certification in accordance with the Constitution and the Rules of Procedure of the Nitijela.
