MUTUAL ASSISTANCE IN CRIMINAL MATTERS (AMENDMENT) ACT 2011

AN ACT

to amend Sections 404 and 422 of the Mutual Assistance in Criminal Matters Act, 2002 to allow the Republic of the Marshall Islands to provide mutual assistance pursuant to an agreement or to jurisdictions which provide or may provide reciprocal assistance.

BE IT ENACTED BY THE NITIJELA OF THE REPUBLIC OF THE MARSHALL ISLANDS:

Section 1. Short Title.

This Act may be cited as the Mutual Assistance in Criminal Matters (Amendment) Act, 2011.

Section 2. Amendments.

(1) Section 404 is hereby amended to read as follows:

§404. Application.

This Act applies to the Republic of the Marshall Islands and to any foreign State which may request assistance in criminal matters on a reciprocal basis.

(2) Section 422 is hereby amended as follows:

§422. Regulation.

In accordance with the foregoing, the Minister of Justice may prescribe such rules and regulations the Minister may deem necessary to provide assistance in accordance with any multilateral or bilateral assistance treaty to which the RMI is a party.

Section 3. Effective Date.

This Act shall take effect in accordance with the Constitution and the Rules of Procedures of the Nitijela.
