An Act to establish the compensation for judges.

§401. Short Title.


This Chapter may be cited as the 'Judicial Compensation Act 1983.' [P.L. 1983-3, §1.]


§402. Compensation otherwise than in the Community Courts.


(1) The annual salaries of judges, other than judges of the Community Courts, are as follows:


Chief Justice of the Supreme Court
$30,000


Associate Judge of the Supreme Court
$25,000


Chief Justice of the High Court
$55,000-60,000


Associate Justice of the High Court
$50,000 - $55,000


Presiding Judge of the District Court
$33,000


Associate Judge of the District Court
$30,000


Chief Judge of the Traditional Rights Court
$33,000


Associate Judge of the Traditional Rights Court
$30,000

(2) The judges are also entitled to allowances and other benefits as provided for contract officers of the Public Service.


(3) In each case the compensation is subject to the usual deductions from salary. [P.L. 1983-3, §2, amended by P.L. 1984-16, §2, including a compensation rate for an Associate Judge of the Supreme Court; P.L.1984-20, §2; P.L. 1985-7, §2; amended by P.L. 1995-135, §6.][salaries adjusted upwards by P.L. 2001-23[P.L. 2003-78 raised salary levels of Presiding judge and Assoc. judges of D.C to $33,000 and $30,000 respectively]


§403. Compensation of judges of the Community Courts. The annual salary of a judge of the a Community Court is $2,400. [Salary set at $2,400 by P.L. 200123 §1(B)]]


§404. Forfeiture of Compensation.


(1) Notwithstanding anything to the contrary in this Chapter or any other law, a judge of a court of record shall forfeit the salary for the judicial office held by the judge while any cause before the judge remains pending and undetermined for 45 days after it has been submitted for decision.

(2) The Clerk of Courts shall have an affirmative duty to immediately notify the Ministry of Finance with respect to any judge which has a cause(s) before him or her which has remained un-acted upon for the period referred to in subsection (1). Upon such notification, the Ministry of Finance shall withhold, as having been forfeited, all pay to such judge until it is further notified by the Clerk of Courts that all causes before such judge have been brought current for purposes of this Section.
