Short title


1. This Act may be cited as the Provident Fund (Amendment) Act 2012.


Amendment of Part VI section 20(1)


2. Part VI Section 20(1) of the Provident Fund Ordinance Cap 78A is amended by adding a new paragraph at the end which shall read –


" (f) has not been employed for more than 6 months and the Board is of the opinion that such member suffers financial hardship, and the Board may approve the amount of withdrawal sufficient to alleviate such hardship,"


Amendment of Part VIA


3. Part VI is amended by adding a new section after section 28 which shall read –


"Amount approved no to be altered


28A. Subject to the provisions of Parts VIA and VIB and section 28 the amount approved by the Board to be paid out to a member or in respect of a member shall not be altered by any lender or person unless the member himself or, where a member has died, his nominee or whoever shall have been appointed by the Court, has consented to such alteration.


Explanatory Memorandum


This amendment Act has two main objects. The first is to enable a member who has suffered or about to suffer severe financial hardship due to a loss of job for at least six months to apply for a withdrawal of such amount of provident fund as the Board may consider sufficient to alleviate the financial hardship in question.


The second object is to prevent any member (or any person so authorized by this Ordinance to act for the member) who is about to receive payment of what the Board has approved to be paid to him from being subjected to alterations not authorized by the Ordinance.
