AN ACT TO AMEND THE PROCUREMENT ACT 2002

Commencement:
2016

MADE by the Maneaba ni Maungatabu and assented to by the Beretitenti

Short title

  1. This Act may be cited as the Procurement (Amendment) Act 2016.

Interpretation

  1. In this Act "the Principal Act" means the Procurement Act 2002 as in force prior to this enactment

Amendment of section 52


  1. Section 52 of the Principal Act is amended by adding subsection (3) as follows: -

“(3). Any person who claims that the procurement entity has acted in contravention of this to the detriment of the public interest may seek judicial review under section 56.”


Explanatory Memorandum


The Main object of the Act is to provide for a legal avenue to enable any person to apply for judicial review of any action or omission of the procurement entity which is not in compliance with the provisions of the Procurement Act 2002
