An Ordinance to make provision for offences and penalties in respect of certain matters in connection with the British Nationality Act 1948 and to provide for the fees to be paid on the Gilbert Islands in respect of various things and matters to be granted or done under the provisions of the said Act

Commencement: 22nd July 1949


Short Title


1. (1) This Ordinance may be cited as the British Nationality (Offences and Fees) Ordinance.

(2) In this Ordinance the expression "the Act" means the British Nationality Act 1948.


Offences


2. (1) Any person who for the purpose of procuring anything to be done or not to be done under the Act makes any statement which he knows to be false in a material particular, or recklessly makes any statement which is false in a material particular shall be liable to imprisonment for 3 months.


(2) Any person who fails to comply with any requirement imposed on him by regulations made under the Act with respect to the delivering up of certificates of naturalization shall be liable to a fine of $200.


Schedule of fees


3. (1) The fees appointed in the Schedule shall, subject to any provision for remission of or release from payment therein contained, be taken in the various matters respectively specified where such, matters are granted or done within the Gilbert Islands under the Act and shall be paid to the officer and in the manner shown in subsection (2) of the Schedule.


(2) Fees shall be paid in local currency at the rate of exchange prevailing for sterling on the date of payment.


Amendment of Schedule


4. The Governor may by order add to or amend the Schedule.

*Where a husband and wife apply at the same time for registration for the United Kingdom and Colonies under section 5A (2) of the 1948 Act or for the grant of certificates of naturalisation and are residing together at the time of the applications and the fee payable in respect of the husband's registration or certificate is paid, the fee payable in respect of the wife’s registration or certificate shall be £35.
