Presidential Instrument of Notice of Suspension of Chief Justice upon Establishment of a Tribunal to Investigate Serious Allegations of Misbehaviour made Against Him - GN 49, 2007

PRESIDENTIAL INSTRUMENT OF NOTICE OF SUSPENSION OF CHIEF JUSTICE UPON ESTABLISHMENT OF A TRIBUNAL TO INVESTIGATE SERIOUS ALLEGATIONS OF MISBEHAVIOUR MADE AGAINST HIM


IN exercise of the powers conferred upon the Interim Government and upon the exercise of my own deliberative judgment as President of the Republic of the Fiji Islands and by the executive authority of the State and with all such other powers as may appertain, I, Josefa Iloilovatu Uluivuda, President of the Republic of the Fiji Islands, do hereby make this Notice that upon being amply satisfied that the question of removing the Chief Justice from office ought to be investigated in terms of section 138(3) of the Constitution, I hereby appoint a Tribunal (the Chairperson and members to be advised) to investigate and determine whether the Chief Justice Daniel Fatiaki should be removed from office for breach of the provisions of s.138 (1) of the Constitution.


And I hereby forthwith suspend the said Chief Justice Daniel Fatiaki from office in accordance with section 138 (4) of the Constitution.
