MARINE ACT, 1986
(ACT NO. 35 OF 1986)


MARINE (CERTIFICATE OF COMPETENCY (AUTHORISED CAPACITIES)) REGULATIONS, 1989


IN exercise of the powers conferred upon me by sections 98, 99, 143 and 212 of the Marine Act, 1986. I have made the following Regulations -


Short Title


1. These regulations may be citied as the Marine (Certificates of Competency (Authorised Capacities)) Regulations, 1989.


Object


2. These Regulations prescribe the capacities the holder of each grade of certificate of competency may serve in on a registered vessel.


Regulations to be read as one


3.-(1) There Regulations are to be read as one with the Marine (Certificates of Competency and Manning of Vessels) (General) Regulations, 1989, and the other Regulations referred to in those Regulations.


(2) In particular words and phrases defined in the Marine (Certificate of Competency and Manning of Vessels) (General) Regulations, 1989 have the same meaning when used in these Regulations.


Application


4. These Regulations apply to registered vessels 10 metres or more in length.


Authorised capacity (deck officers)


5.-(1) The highest capacity in which a person holding a grade certificate of competency as a deck officer may serve on a registered vessel is that shown against that grade in the Table set out in Part I of the Schedule.


(2) The holder of a master's grade of certificate of competency may serve in a master's capacity of any grade below that of the grade of certificate held by him or in mate's capacity at the same or lower grade.


(3)The holder of a mate's grade of certificate of competency may serve in a mate's capacity of any grade below that of the grade of certificate held by him.


(4) The holder of a Grade 1 (Mate) or Grade 2 (Mate) certificate of competency may serve in a Grade 5 (Master) capacity.


Authorised capacities (engineering officers)


6.-(1) The highest capacity in which a person holding a grade of certificate of competency as an engineering officer may serve on a registered vessel is that shown against that grade in the Table set out in Part 2 of the Schedule.


(2) The holder of a certificate of competency as an engineering officer may serve in an engineering capacity in a vessel in any grade below that of the grade of certificate held by him.


(3) The holder of a certificate of competency as an engine operator may serve in the capacity in which an engine room watchkeeping rating may serve if the holder of the certificate has at least 2 months seagoing service as an engine room watchkeeping rating on a vessel having a propulsion power of at least 750 KW.


Authorised capacity (able seaman and deck watchkeeping rating)


7. A person holding an able seaman certificate or a deck watchkeeping rating certificate may serve in a deck department capacity on a registered vessel where the number of such ratings serving in that capacity in the department is not less than the number specified in Part 3 of the Schedule in respect of the size of the vessel and the trade it is engaged in.


Authorised capacity (engine room watchkeeping rating)


8. A person holding an engine room watchkeeping rating certificate may serve in an engine department capacity on a registered vessel where the number of such ratings serving in that capacity in that department is not less than the number specified in Part 4 of the Schedule in respect of the propulsion power of the vessel and the trade it is engaged in.


Authorised capacity (sailing licence)


9.-(1) Subject to subregulations (2) and (3), a person holding a sailing licence may serve as the master of a registered vessel of less than 100 gross tonnage.


(2) A sailing licence is not valid except in respect of the area specified in it.


(3) A sailing licence is not valid in respect of sailing vessels unless it is endorsed with a sailing endorsement.
