(DECREE No. 49 of 2010)


Commerce Commission (On-Spot Penalties) Regulations 2011


IN exercise of the powers conferred upon me by section 158 of the Commerce Commission Decree 2010, I make the following Regulations-


Short title and commencement


1. These Regulations may be cited as the Commerce Commission (On-Spot Penalties) Regulations 2011 and are deemed to have come into effect on the commencement date of the Commerce Commission Decree 2010.


Repeal


2. The Commerce Commission (On-Spot Penalties) Regulations 2010 is hereby repealed.


Form


3. For the purposes of section 59(1) the prescribed On-Spot Penalty Form is set out in Schedule 1.

4. However, if you-


(i) Fail to pay the determined penalty;


(ii) Intend to contest the proceedings; or


(iii) For any other matters, you do not wish to respond to this notice;


The Commerce Commission will seek to initiate prosecution and/or legal proceedings against the above-named person or company who committed the offence.


Note: section 59(2) of the Decree provides if a person is found guilty by a court a liability for a penalty up to $15,000 for a natural person or $20,000 for a body corporate arises.
