SUGAR INDUSTRY ACT (AMENDMENT) PROMULGATION 2007
(PROMULGATION NO.20 OF 2007)

IN exercise of the powers conferred upon the Interim Government, and upon the exercise of my own deliberate judgment as President of the Republic of the Fiji Islands as to what is best and good for the people of Fiji, and by the executive authority of the State in accordance with section 85 of the Constitution and such other powers as may appertain, and with the advice of Cabinet, I, Josefa Iloilovatu Uluivuda, make this Promulgation –

TO AMEND THE SUGAR INDUSTRY ACT

Short title and commencement

1. This Promulgation maybe cited as the Sugar Industry Act (Amendment) Promulgation 2007, and is deemed to have come into force on 13th April 2007.

Section 32 amended

2. The Sugar Industry Act (referred to as the “Act”) is amended-

(a) by repealing paragraph (b) of section 32(1); and

(b) by repealing subsection (4) of section 35.

Deferment of Council's election

3.-(1) The elections of members of the Council to be conducted on or before 14 of April 2007 pursuant to section 35(3) of the Act shall be deferred for 12 months and are to be conducted on or before 30 April 2008.

(2) The existing members of the Council elected under paragraph (a) of section 32(1) shall continue in their offices as if they continue to be duly elected under section 32(3) until the date of the next general elections to the Council.

(3) For the avoidance of doubt, the members of the Council nominated under paragraph (b) of section 32(1) shall cease to be members of the Council from the date their appointments were terminated by the Minister.
