STAMP DUTIES ACT (AMENDMENT) DECREE 1991

______

A DECREE TO AMEND THE STAMP DUTIES ACT IN RESPECT OF EXEMPTION OF THE PUBLIC RENTAL BOARD FROM STAMP DUTIES

IN exercise of the powers vested in me as President of the Sovereign Democratic Republic of Fiji and Commander-in-Chief of the Armed Forces and acting in accordance with the advice of the Prime Minister and the Cabinet, I hereby make the following Decree-

Short title

1. This Decree may be cited as the Stamp Duties Act (Amendment) Decree, 1991.

Interpretation

2. In this Decree, unless the context otherwise requires "the Act" means the Stamp Duties Act.

Schedule to the Act amended

3. The Schedule to the Act is hereby amended in "Part II-General Exemptions From Stamp Duty" by inserting the following paragraphs immediately after paragraph (22)-

"(23) Every agreement, whether creating a mortgage, pledge, lien or other security over property or not, whereby the Public Rental Board, constituted under the Housing Act as amended by Section 5 of the Housing (Amendment) Decree, 1989, agrees to repay a loan raised by it for the purpose of carrying out its statutory functions.

(24) Every instrument executed by or on behalf of the Public Rental Board constituted under the Housing Act as amended by Section 5 of the Housing (Amendment) Decree 1989 when the other party, or one of the other parties, thereto is a worker within the meaning of the Housing Act.

(25) Every instrument for the transfer of land or of any estate or interest therein to the Public Rental Board."

Commencement

4. This Decree shall be deemed to have come into force on 8th May 1989.
