AN ACT

TO AMEND THE PORTS AUTHORITY OF FIJI ACT
(CHAPTER 181)

ENACTED by the Parliament of Fiji-

Short title

1. This Act may be cited as the Ports Authority of Fiji (Amendment) Act, 1996 and shall come into force on the day it is published in the Fiji Republic Gazette.

Interpretation

2. In this Act, the Ports Authority of Fiji Act (Cap. 181) is referred to as the "principal Act".

Section ″16″ amended

3. Section "16" of the principal Act is amended in subsection "(1)", by repealing it and substituting the following:

"(1) The common seal of the Authority shall not be affixed except pursuant to a resolution of the Authority and in the presence of either the Chairman or the Director-General and one member, and such affixing shall be authenticated by the signature of such persons".

Section 22 amended

4. Section "22" of the principal Act is amended in the proviso to subsection "(1)", by deleting the expression and figures "$50,000" and substituting the expression and figures "$500,000".

Section "25"amended

5. Section "25 "of the principal Act is amended in subsection "(3)", by repealing it and substituting the following:-

"(3) The accounts of the authority shall be audited annually by an Auditor appointed by the authority with the approval of the Minister. No person shall be appointed Auditor under this provision unless he is a Chartered Accountant registered under the provisions of the Fiji Institute of Accountants Act".

Section "26"amended

6. Section "26" of the principal Act is amended in paragraph "(b)" of subsection "(1)" by:-

(a) deleting all the expressions and words after the word "Auditor" in the second line;

(b) inserting a semi-colon after the ward "Auditor".

Passed by the House of Representatives this Fourteenth day of May, in the year of our Lord, One Thousand Nine Hundred and Ninety-Six.

Passed by the Senate this Seventh day of June, in the year of our Lord One Thousand, Nine Hundred and Ninety-Six.
