AN ACT

TO AMEND CERTAIN ACTS AND REGULATIONS TO GIVE EFFECT TO THE RESTRUCTURE OF THE PROVINCIAL ADMINISTRATION AND FOR RELATED MATTERS

ENACTED by the Parliament of the Fiji Islands-

Part I - PRELIMINARY

Short title

1. This Act may be cited as the Miscellaneous Amendments (Provincial Administrators) Act 2005.

Natural Disaster Management Act

2. The Natural Disaster Management Act 1998 (Act No. 21 of 1998) is amended-

(a) in section 2 in the definition of "Standard Operating Procedures", by inserting", Provincial Administrators" after "Divisional Commissioners";

(b) in section 6, by inserting ", Provincial Administrators" after "Divisional Commissioners";

(c) in section 14(1), by inserting "Provincial Administrators" after "Divisional Commissioners";

(d) in section 17(3), by inserting "or the Provincial Administrator" after "Divisional Commissioner";

(e) in section 20(1) -

(i) by inserting ", Provincial Administrators" after "Divisional Commissioners";

(ii) by inserting "provincial" after "divisional";

(f) in section 23, in paragraphs (e) and (f) respectively, by inserting "Provincial Administrator or" before "District Officer";

(g) in section 28(1), by inserting "Provincial Administrators" after "Divisional Commissioners";

(h) in section 28(4), by inserting "Provincial Administrators or" before "District Officers";

(i) in section 29(1) and (2) respectively, by inserting "Provincial Administrator or" before "District Officer";

(j) in section 30(3), by inserting "Provincial Administrator or" before "District Officer";

(k) in section 31(2), by inserting "Provincial Administrators" after "Divisional Commissioners";

(l) in section 33, by inserting "Provincial Administrator or" before "District Officer";

(m) in section 35(2), by inserting "Commissioners, Provincial Administrators" after "Divisional";

(n) in section 40(2), by inserting "Provincial Administrators" after "Divisional Commissioners".

Public Order Act and its Regulations amended

3. - (1) The Public Order Act is amended in section 2 in the definition of "appropriate authority" by deleting "district officer" and substituting "Divisional Commissioner".

(2) The Public Order Regulations are amended by deleting "District Officer" and substituting "Divisional Commissioner" wherever it appears in the Regulations.

Lotteries Regulations amended

4. Lotteries Regulations made under the Gaming Act (Cap. 273) are amended in regulation 2, in the definition of "authority", by inserting "Provincial Administrator or" before "district officer", and "or Provincial Administrator, as the case may be," after "Commissioner".
