DECREE NO. 45

INTERNAL SECURITY (SUSPENSION) DECREE 1988

A DECREE TO SUSPEND THE INTERNAL SECURITY DECREE 1988 AND TO PROVIDE FOR MATTERS ANCILLARY THERETO

IN exercise of the powers vested in me as President and Commander-in-Chief of the Republic of Fiji and acting in accordance with the advice of the Prime Minister and Cabinet, I hereby make the following Decree-

Short title

1. This Decree may he cited as the Internal Security (Suspension) Decree, 1988.

Interpretation

2. In this Decree, "the principal Decree" means the Internal Security Decree, 1988.

Commencement

3. This Decree shall be deemed to have come into force on 18 November 1988.

Principal Decree suspended

4. Subject to the provisions of this Decree the principal Decree is hereby suspended.

Offences, penalties, etc., not to be affected

5. The suspension of the principal Decree by section 4 of this Decree shall not-

(a) affect the previous operation of the principal Decree or anything duly done or suffered under that Decree;

(b) affect any penalty or punishment incurred in respect of any offence committed against the principal Decree; or

(c) affect any investigation or legal proceeding in respect of any such penalty or punishment incurred or in respect of any offence committed against the principal Decree before the commencement of this Decree, and any such investigation or legal proceeding may be instituted, continued or enforced, and any penalty or punishment may be imposed as if the principal Decree had not been suspended.

President may re-activate principal Decree

6. The President acting upon the advice of the Prime Minister and the Cabinet, may at anytime by Order provide that section 4 of this Decree shall cease to have effect and accordingly the principal Decree shall cease to be suspended.
