IMMIGRATION ACT (AMENDMENT) PROMULGATION 2008
(PROMULGATION NO. 3 OF 2008)

IN exercise of the powers conferred upon the Interim Government, and upon the exercise of my own deliberate judgment as President of the Republic of the Fiji Islands as to what is best and good for the people of Fiji, and by the executive authority of the State in accordance with section 85 of the Constitution and such other powers as may appertain, and with the advice of Cabinet, I Josefa Iloilovatu Uluivuda, make this Promulgation-

TO AMEND THE IMMIGRATION ACT 2003

Short title & commencement

1. This Promulgation maybe cited as the Immigration Act (Amendment) Promulgation 2008, and shall come into force on the 25th day of February 2008.

Section 13 Amended

2. Section 13(2) of the Immigration Act 2003 is amended in paragraph (g) by adding the following paragraph at the end after "Fiji Islands;" in the last line:

"Provided that and notwithstanding anything contained in this Act, the decision of the Minister

made under this paragraph shall be final and conclusive and shall not be questioned or reviewed in

any court."

Section 58 Amended

3. Section 58 of the Immigration Act 2003 is amended by adding the following new sub-section after sub-

section (7):

"(8) No appeal shall lie from decisions made by an immigration officer acting in accordance with the directions of, or instructions given in respect of any particular case by, the Minister."
