Head of State and Executive Authority of Fiji (Amendment) (No. 1) Decree 1988

DECREE NO. 20

HEAD OF STATE AND EXECUTIVE AUTHORITY OF FIJI (AMENDMENT) (NO. 1) DECREE 1988

IN exercise of the powers conferred upon me by the Appointment of Head of State and Dissolution of Fiji Military Government Decree, I as President and Commander-in-Chief of the Republic of Fiji, acting in accordance with the advice of Cabinet hereby make the following decree-

Short title

1. This Decree may be cited as the Head of State and Executive Authority of Fiji (Amendment) (No. 1) Decree 1988.

Section 3 amended

2. The provision of section 3 of the Head of State and Executive Authority of Fiji Decree 1988 shall be amended by the inclusion of the following provisos to that section:

“Provided that when the first President is unable to perform the functions of his office by reason of his absence from Fiji or by reason of illness or any other cause, those functions shall be performed by such person as may be appointed by the President after consultation with the Prime Minister and the Cabinet;

Provided further that if the Prime Minister, acting in his own deliberate judgment, considers that it is impracticable for the first President to appoint such person to perform the functions of his office owing to illness or absence or any other cause the Prime Minister may, acting in accordance with the advice of the Great Council of Chiefs make such appointment and shall cause it to be published in the Gazette.”.
