HIV-AIDS (Amendment) Decree 2011

GOVERNMENT OF FIJI

HIV/AIDS (AMENDMENT) DECREE 2011
(DECREE NO. 38 OF 2011)

IN exercise of the powers vested in me pursuant to section 4 of the Office of the Vice-President and Succession Decree 2009 (Decree No. 8 of 2009), I hereby make the following Decree—

Short title and commencement

1. This Decree may be cited as the HIV/AIDS (Amendment) Decree 2011, and shall be deemed to come into force on the date of commencement of the HIV/AIDS Decree 2011.

Section 4 amended

2. Section 4 of the HIV/AIDS Decree 2011 ("the Decree") is amended by deleting subsection (2).

Section 5 amended

3. Section 5 of the Decree is amended by deleting subsection (2).

Section 22 amended

4. Section 22 of the Decree is amended by—

(a) renumbering it as subsection (1); and

(b) inserting the following new subsection (2)—

"(2) Nothing in subsection (1) or in section 21 renders unlawful any discrimination inrelation to recruitment, promotion, posting or discharge of members of the Republic of Fiji Military Forces."

Section 29 amended

5. Section 29 of the Decree is amended in subsection (2) by deleting paragraphs(e) and (f), and replacing with the following—

"(e) where a person tested is a member of the Republic of Fiji Military Forces and testing isrequired for operational reasons, including the requirement of overseas duties; or

(f) where a person tested is a member of the uniformed services and testing is required forthe purposes of overseas duties."

Section 40 repealed

6. Section 40 of the Decree is repealed.
