DANGEROUS DRUGS ACT (AMENDMENT) (NO. 1) DECREE, 1991

A DECREE TO FURTHER AMEND THE DANGEROUS DRUGS ACT

IN exercise of the powers vested in me as President of the Sovereign Democratic Republic of Fiji and Commander-in-Chief of the Armed Forces and acting in accordance with the advice of the Prime Minister and the Cabinet, I hereby make the following Decree-

Short title

1.-(1) This Decree may be cited as the Dangerous Drugs Act (Amendment) (No. 1) Decree.

(2) In this Decree, the Dangerous Drugs Act (Chapter 114) is referred to as “the principal Act”.

Section 8(b) of the principal Act amended

2. Section 8(b) of the principal Act is amended-

(a) by inserting the word “immediate” after the word “to” in the sixth line;

(b) by repealing the proviso to Section 8(b) and replacing it by the following proviso:

“Provided that the provisions of Section 29 of the Penal Code and any other, law shall not apply to any sentence to be imposed under this Act”.
