CONSTITUTION OF THE SOVEREIGN DEMOCRATIC REPUBLIC OF FIJI (PROMULGATION) DECREE 1990 (AMENDMENT NO. 1) DECREE 1990

IN exercise of the powers vested in me and pursuant to Section 5(2) of the Constitution of the Sovereign Democratic Republic of Fiji (Promulgation) Decree 1990, I as President of the Sovereign Democratic Republic of Fiji, acting in accordance with the advice of the Prime Minister and the Cabinet hereby make the following Decree-

Short title

1. This Decree may be cited as the Constitution of the Sovereign Democratic Republic of Fiji (Promulgation) Decree 1990 (Amendment No. 1) Decree 1990.

Section 5 amended

2. Section 5 of the Constitution of the Sovereign Democratic Republic of Fiji (Promulgation) Decree 1990 is amended by the addition of the following subsection as subsection (3) immediately after subsection (2):-

“(3) When the President is unable to perform the functions of his office by reason of his absence from Fiji or by reason of illness or any other cause, these functions shall be performed by such person as may be appointed by the President after consultation with the Prime Minister and the Cabinet;

Provided that if the Prime Minster, acting in his own deliberate judgment, considers that it is impractical for the President to appoint such person to perform the functions of his office owing to illness or absence or any other cause the Prime Minister may, acting in accordance with the advice of the Bose Levu Vakaturaga, make such appointment and shall cause it to be published in the Gazette.”
