THE REPUBLIC OF FIJI


DECREE NO. 18


AMNESTY DECREE 1988


ARRANGEMENT OF SECTIONS

IN exercise of the powers conferred upon me by the Head of State and Dissolution of Fiji Military Government Decree, I as President and Commander-in-Chief of the Republic of Fiji, acting in accordance with the advice of the Cabinet hereby make the following decree:-


Short title


1. This Decree may be cited as the Amnesty Decree 1988.


Grant of Unconditional pardon to prisoners on life sentence


2. Prisoners whose names appear in Schedule 1 hereto and who, on 7th October 1987 are serving life sentences and who on that date have served nine years or more of such sentence in any prison in Fiji are hereby granted unconditional pardon in respect of their conviction so that all pains, penalties and punishments whatsoever that ensued from the conviction might be removed from them.

3. Prisoners whose names appear in Schedule II hereto and who, on 7th October 1987 are serving life sentences in any prison in Fiji but who on that date are on release on conditional pardon are hereby granted unconditional pardon in respect of their conviction so that all pains, penalties and punishments whatsoever that ensued from the conviction might be removed from them.


Grant of three months unconditional pardon to prisoners serving on 7th October 1987


4. All prisoners who on 7th October 1987 were serving their term of sentence either in any prison in Fiji or under a Compulsory Supervision Order and are still serving the same sentence on the date of coming into force of this Decree are hereby granted three months unconditional pardon so that the length of their term of sentence are reduced by three months accordingly.


No right to compensation


5. The grant of pardon made under this Decree shall not confer on any person a right to claim or to commence any action for compensation either directly or indirectly in respect of the conviction and imprisonment or in respect of any delay in their actual release from any prison in Fiji (as a consequence of the pardon granted) if such delay is necessary and reasonable for the purpose of effecting the administrative machinery in relation to their release and such delay shall not be held to be in contravention or inconsistent with the provisions of any law relating to the protection of fundamental rights and freedoms of the individual.


Coming into force


6. This Decree shall be deemed to have come into force on 8th February 1988.
