An Act to amend the Transport Act 1966

(25 August 1994

BE IT ENACTED by the Parliament of the Cook Islands in Session assembled, and by the authority of the same as follows:

  1. Short Title

(1) This Act may be cited as the Transport Amendment Act 1994 and shall be read together with and deemed part of the Transport Act 1966 (hereinafter referred to as "the principal Act").

(2) This Act shall come into force on the first day of October 1994.

  1. Unlicensed persons not to drive motor vehicles

Section 17 of the principal Act is amended, by repealing subsections (4), (5) and (6), and substituting the following –

"(4) Every application for a motor driver's licence, shall be in such form and accompanied by such application fee as shall be prescribed.
(5) Every motor driver's licence, shall be in such form and contain such particulars as shall be prescribed by regulations made under this Act, and different forms may be prescribed in respect of different islands.
(6) Save as provided in this Act with respect to the cancellation or suspension of a motor driver's licence, every such licence shall continue in force until the day immediately before the birthday of the holder next following the date of issue of the licence, and subject to payment of the appropriate fee, may be renewed at annual 5 yearly, or 10 yearly intervals."
  1. Savings and transitional

(1) Notwithstanding section 17 of the principal Act as amended by section 2 of this Act, every motor driver's licence lawfully issued and still in force on the date of coming into force of this Act, shall continue in force until the day before the birthday of the holder next following the coming into force of this Act, and thereafter, any unexpired portion of the fee paid in respect of that licence shall, in respect of any person applying for a renewal of that motor driver's licence in the form then prescribed, be credited to that person on account of the fee then prescribed in respect of that renewed licence.

(2) Nothing in this Act shall affect any cancellation or suspension of a motor driver's licence imposed by the High Court.
