An Act to provide for licensing and restricting the use of pool tables

(14 November 1972

BE IT ENACTED by the Legislative Assembly in Session assembled, and by the authority of the same, as follows:

  1. Short Title

This Act may be cited as the Pool Tables Licensing Act 1972.

  1. Interpretation

In this Act, unless the context otherwise requires, -

"Minister" means the Minister responsible for finance:
"Owner" in relation to any pool table includes the owner, hirer, bailee and any person having possession or control of any pool table:
"Pool table" means a table used for playing the games of pool, snooker, billiards or any game of the like kind.
  1. Licensing of pool tables

(1) It shall be unlawful for any person to use any pool table for playing the games of pool, snooker or billiards, or any game of the like kind, in respect of which a charge is made for the use thereof or to which the public has access, unless a licence has been granted in respect of that pool table pursuant to this Act.

(2) Every application for a licence of a pool table shall be made in writing in the form or to the effect of the form numbered 1 in the Schedule hereto.

(3) Every licence of a pool table shall be granted by the Minister in the form or to the effect of the form numbered 2 in the Schedule hereto and subject to the provisions of this Act may be granted subject to such terms and conditions as the Minister shall think fit.

(4) Every licence shall be granted as from the first day of September in each year and shall be valid for a period of one year.

  1. Matters to be considered in granting licences

In considering any application for a licence of a pool table the Minister shall have regard to -

(a) The number of pool tables considered desirable to be licensed in the area or district; and
(b) The suitability of the premises or building in which the pool table is to be used.
  1. Fees

There shall be payable on the grant of any licence a fee of $50.00 in respect of each pool table licensed therein.

  1. Restriction of hours

It shall be unlawful for any person to use any pool table for playing the games of pool, snooker, or billiards or any game of the like kind, in respect of which a charge is made for the use thereof or to which the public has access, or any Sunday, Good Friday or Christmas Day, or before the hour of 12 noon or after the hour of 11.30 p.m. on any Saturday or other Public Holiday or before the hour of 12 noon or between the hours of 1 p.m. and 4 p.m. or after the hour of midnight on any other day.

  1. Restriction on age

It shall be unlawful for any person under the age of 18 years to use any pool table for playing the games of pool, snooker, or billiards or any game of the like kind, in respect of which a charge is made for the use thereof or to which the public has access.

  1. Offences

(1) The owner of any pool table who acts in contravention of any provision of this Act or who permits or allows any other person to use the pool table in contravention of any provision of this Act commits an offence and shall be liable on conviction to a fine not exceeding four hundred dollars.

(2) Any other person who acts in contravention of any provision of this Act commits an offence and on conviction shall be liable to a fine not exceeding fifty dollars.

  1. Revocation of licence

If the Minister is satisfied that any licence has been obtained by fraud or misrepresentation he may, by notice in writing given at any time to the person to whom the licence was granted revoke the licence without refunding any fee or any part of any fee paid in respect of the licence.
