An Act to amend the Primary Produce Marketing Board Act 1970-71

BE IT ENACTED by the Legislative Assembly of the Cook Islands in Session assembled, and by the authority of the same, as follows:

1. Short Title and commencement

(1) This Act may be cited as the Primary Produce Marketing Board Amendment Act 1971-72 and shall be read together with and deemed part of the Primary Produce Marketing Board Act 1970-71 (hereinafter referred to as "the principal Act").

(2) This Act shall be deemed to have come into force on the 23rd day of March 1971.

2. Vacancies of the Board

Subsection (1) of section 5 of the principal Act is hereby repealed and the following subsection substituted:-

"(1) In the event of any vacancy occurring by death, resignation or otherwise in the office of -

• (a) Any member of the Board appointed by the Minister, that vacancy shall be filled by appointment by the Minister; and
• (b) Any member representing the growers and producers of controlled produce in the Cook Islands, that vacancy shall be filled by appointment by the Minister on the unanimous recommendation of the remaining members of the Board".

3. Annual conference

Paragraph (a) of subsection (2) of section 7 of the principal Act is hereby amended by omitting the words "one representative", and substituting the words "two representatives".

4. Assets and liabilities of the Board

Subsection (1) of section 20 of the principal Act is hereby amended by omitting the words "on the coming into force of this Act", and substituting the words "on the first day of October 1971".

This Act is administered by the Primary Produce Marketing Board.
