BE IT ENACTED by the Parliament of the Cook Islands in Session assembled and by the authority of the same as follows:

1. Short Title and commencement - (1) This Act may be cited as the Post Office Amendment Act 1991 and shall be read with and deemed part of the Post Office Act 1959 (herein referred to as the "principal Act").

(2) This Act shall come into force on a date to be appointed by the Postmaster-General by notice in the Gazette.

2. Post Office Act 1959 amended - (1) The enactments referred to in the first column of the First Schedule are amended in the manner set out in the second column of that Schedule.

3. Employees of Post Office to be public servants - Every employee of the Post Office shall be a public servant deemed to have been employed under the provisions of the Public Service Act 1975.

4. Savings - Without limiting the provisions of the Acts Interpretation Act 1924, the repeal of any provision by this Act shall not affect any document made or anything whatsoever done under the provisions so repealed or under any corresponding former provision, and every such document or thing, so far as it is subsisting or in force at the time of the repeal and could have been made or done under the provision so repealed, shall continue and have effect as if the provision repealed had not been repealed.

Section 2	By repealing that section.
Section 3	By deleting the words "Director-General" here they appear and substituting the word "Manager".
Section 5	By repealing subsection (2);
Section 6	By repealing that section and substituting the following section-

	"6. Appointment of Manager – There shall from time to time be appointed under the provisions of the Public Service Act 1975 a Manager of the Post Office who shall be responsible to the Postmaster-General in the performance of his functions and who shall be the administrative head of the Post Office."

	By repealing subsections (3) (4) and (5);
Section 7	By deleting the words "Director-General" and substituting the word "Manager".
Section 8	By repealing that section;
Section 9	By deleting the words "postal", "telegraph" and "telephone";
Section 11	By deleting the words "Director-General" wherever they appear and substituting the word "Manager".
Parts III, IV, V, and VI	By repealing sections 12 to 112 inclusive;
Section 113	By deleting from subsection (3) (e) the words "Home lay-by accounts" and substituting the words "Personal loan accounts";
Section 116	By deleting from subsection (1) the words "Chief Postmaster of the postal district, or to the postmaster" and substituting the word "Manger or Officer";
Section 118A	By repealing subsection (1);
Section 119	By deleting from subsection 92) the words "in the manner prescribed by section 75 of the Public Revenues Act 1953" and substituting the following words "or loaned in such manner and on such conditions as the Postmaster-General may with the consent of the Minister of Finance from time to time determine;
Section 120	By deleting the words "Consolidated Fund" and substituting the words "Public Account".
Section 121	By repealing that section;
Section 122	By repealing that section;
Section 127	By deleting from subsection (1) the words "at such rate of interest as the Minister of Finance may from time to time determine in that behalf by notice in the Gazette".
	By deleting the proviso to subsection (3) and substituting the following proviso-
	"Provided that the rate of interest, if any, payable in respect of money withdrawn shall not exceed the rate of interest payable in respect of ordinary deposits at the time when the withdrawal is made".
Section 128	By repealing that section;
Section 129	By repealing that section;
Parts IX, X, XI	By repealing sections 141 to 168 inclusive;
Section 170	By deleting the words "Director-General" where they appear and substituting the word "Manager."
Section 172	By deleting from subsections (1) and (2) the words "Consolidated Fund" and substituting therefore the words "Public Account";
Section 173	By repealing that section;
Section 174	By deleting from subsection (1) the words "in addition to the money which may be paid out of the Post Office Account pursuant to section 173 of this Act there shall be paid out of that account" and substituting therefore the words "there shall be paid out of the Post Office Account";
	By deleting paragraph (c) of subsection (1).
Section 175	By repealing that section;
Section 176	By deleting the words "by section 75 of the Public Revenues Act 1953";
Section 177	By repealing that section;
Sections 182, 183, 184, 185 and 186	By repealing those sections;
Parts XIII, XIV, XV and XVI	By repealing sections 187 to 223 inclusive;
Section 226	By repealing subsection (2);
Sections 227, 228, 230 and 235	By repealing those sections;
Sections 237, 238, 244, 246 and 247	By repealing those sections;
Section 250	By repealing subsections(1) (5) (6) (7) and (8);
Second Schedule	By repealing that Schedule;
Third Schedule	By repealing that Schedule;
