An Act to validate and confirm the Customs Tariff Amendment Order 1973


(29 April 1974


WHEREAS by subsection (2A) of Section 31 of the Customs Amendment Act 1921 it is provided that every Order in Executive Council made under Section 12 of that Act and laid before the Legislative Assembly in any session shall expire on the close of the last day of that session except so far as it is expressly validated or confirmed by an Act of the Legislative Assembly passed during that session:


AND WHEREAS subsection (2) of Section 31 of the Customs Amendment Act 1921 requires that every Order in Executive Council made under that Act shall be laid before the Legislative Assembly within fourteen days after the gazetting thereof if the Legislative Assembly is then in session, and, if not, then within fourteen days after the commencement of the next ensuing session; And whereas the Legislative Assembly, although in session, was in recess when the Customs Tariff Amendment Order 1973 was gazetted on the 24th of September 1973, and the session resumed on the 16th of November 1973, and the Order was not laid before the Legislative Assembly until the 13th of December 1973, it is therefore necessary to validate the laying of the said Order:


AND WHEREAS the Customs Tariff Amendment Order 1973 has been made partly under the authority of the said Section 12 of the Customs Amendment Act 1921 and is to be deemed to have been laid before the Legislative Assembly during the present session in accordance with subsection (2) of Section 31 of that Act and it is desirable to validate and confirm that Order:


BE IT THEREFORE ENACTED by the Legislative Assembly of the Cook Islands in Session assembled, and by the authority of the same, as follows:–


1. Short Title – This Act may be cited as the Customs Order Confirmation Act 1973–74.


2. Tabling validated – The laying of the Customs Tariff Amendment Order 1973 (Serial No. 1973/5) before the Legislative Assembly is hereby deemed to have been made in accordance with subsection (2) of Section 31 of the Customs Amendment Act 1921.


3. Order in Executive Council confirmed – The Customs Tariff Amendment Order 1973 is hereby declared to be valid and is hereby confirmed as required by subsection (2A) of Section 31 of the Customs Amendment Act 1921.


This Act is administered in the Customs Department.
