An Act to amend the Air Services Licensing Act 1984

(24 November 1995

BE IT ENACTED by the Parliament of the Cook Islands in Session assembled, and by the authority of the same as follows:

  1. Short Title

This Act may be cited as the Air Services Licensing Amendment Act 1995 and shall be read together with and deemed part of the Air Services Licensing Act 1984 (hereinafter called "the principal Act").

  1. Interpretation

In this Act -

"Existing licence" means an air services licence granted pursuant to the Air Services Licensing Act 1984, and in effect as at the date of coming into force of this Act.
  1. Duration of Licence

The principal Act is amended by repealing section 12 and substituting the following -

"12. Duration of licence
Every licence shall be deemed to have taken effect on such day, whether on, before or after the date on which it is granted as may be stated therein and shall, unless sooner revoked, or unless expressed to expire at an earlier date, expire on the completion of 5 years after the date on which it takes effect:
Provided that where application for the renewal of a licence is duly made as provided in section 14, the licence shall where the application for renewal is not disposed of before the date of expiry of the licence, continue in force until the application is disposed of unless the Minister otherwise directs in writing."
  1. Existing licences unaffected

Notwithstanding section 3 of this Act, every existing licence shall, unless expressed to expire at an earlier date, expire on the completion of one year after the date on which it took effect:

Provided that where application for renewal of an existing licence is duly made as provided for in section 14 of the principal Act, that existing licence shall, where the application is not disposed of before its date of expiry, continue in force until the application is disposed of unless the Minister otherwise directs in writing.
